In the online tournament I am in, the moderator sent us the edition of the rules he thinks is the most accurate and up to date. In those, rule 10.3.2 states you must declare both avoids and intercepts prior to rolling. I will send you a copy of the rules I am talking about.

If you fail the avoid with the capua army you can still intercept with Flaminius’ army afterward, but you would have to declare that you are doing both an avoid and intercept attempt before you roll. You cannot roll to avoid, see the result, and then decide if you want to intercept.

If you do try to intercept with Flaminius and fail, then all CU would take part in the battle. If you intercept and are successful, you could put 2 CUs inside Capua if you wish.

first of all I would like to try to avoid with 3 CUs to Rome (leaving 2 CUs inside the city) - is this legal - or do I have to take 5 CUs with the consuls in the avoid attempt in order not to violate the 5-CU-Consul-rule?

if that fails, I would try to intercept with the army from Naples - is that legal after a failed evasion attempt?

if that succeeds - would the 2 CUs inside Capua take part in the battle?

if that fails - would the 2 CUs insde Capua take part in the battle?
