According to the following rule when armies are created you don't have a choice in selecting your commanding general unless there is a tie (or unless I am misinterpreting it). I know you pay a 2SW penalty if there is another general on the map with a higher rating, but I think that only applies if they are elsewhere on the map and I don't think it inherently gives you the option to pay that penalty to bypass generals in the same space.

5.22 DESIGNATING THE COMMANDING GENERAL: If more than one general is present, then the one with the highest political value is the commanding general. In cases where two or more generals have the highest political value, the owning player determines the commanding general.
