Gentlemen - I'm SO SORRY for failing to get back to you promptly! Really wish someone had given me an extra nudge, or reached out to the other moderators if I failed to respond in 24-48 hrs. I see the game has not progressed since the dispute. I'm not going to discuss all prior digressions, but provide clarity on the current MO. MO warnings were agreed to early on. A supply warning was given on AP5, but missed by the CP player. PBEM is meant to simulate face-to-face play, but obviously things may be missed. In a FtF game, the MO warning would have been explicit and clear. In pbem, something written may be missed, although it is the responsibility of each player to review the log and keep track. The CP player did not intend to ignore the warning, as clearly he desires not to lose the VP and fix it. That being said, the MO warning was given clearly in the log. The AP player has suggested a compromise, however I personally disagree with the suggestion, in that it would NEVER be suggested in a face-to-face game. If an MO is missed (which even does come up on ftf play - accidents happen which are found at end of turn cleanup), the player is given the option to redo their play - not have their play dictated by their opponent. If the AP player believes this was an honest mistake, then CP6 should be redone. The MO warning was given. If the AP player understands that the warning was honestly accidentally missed, it is up to the AP player to allow the CP player to redo their CP6. I will not say that the AP MUST allow the redo, as the warning is in the log. Back to the AP to decide on the redo. If not, -1VP (expensive lesson learned on checking the log to CP). |

Rob, There is no need to refer this to the moderator because the tournament rules already clarify explicitly the outcome here: "The ACTS log is THE authoritative record of the game for all GM purposes." So you're wrong, I issued a Missed MO warning and you have no right to rewind the game to replay your poor decision. Frankly my compromise offer was exceedingly generous since I have no motivation to offer any compromise here at all. Furthermore, the opinions you've expressed in your message are completely and entirely ridiculous. I didn't "bury" my MO warning, it was THE ONLY LINE OF TEXT TO BE READ in my AR5 play. The fact of the matter is you just didn't read it, and you don't want to be held accountable for your own play. I hate to have to explain this to you, but actually reading the messages in a play-by-email game is an essential part of the game for which you are responsible. So you don't just want an MO warning, but now I'm supposed to issue an MO warning double-check too? What if you choose not to read that one too? At what point are you responsible for your own plays? Addressing the previous episodes in the game you brought up: -While the case was that I missed your moved to Miskolcz in 331, and thus had to revise my move in 337/341, your personal opinion about take backs for "communication errors" is not a recognized practice or tournament rule. To repeat: "The ACTS log is THE authoritative record of the game for all GM purposes." So in the case that you had failed to log the move to Miskolcz, I would've been completely justified in taking advantage of the supply situation and calling this an attempt at "unfair play" is insulting and misguided. -I'm glad you feel that the formatting of your own IT MO warning was so noble, but my "acknowledgement" was only made to comment on the ludicrous state of a game where our statistical results are more than three standard deviations apart. To be clear, no explicit acknowledgement of receipt of MO/Supply warnings is required or expected - the default expectation of a play-by-email game is that the players read the game log. I will be notifying the moderator of your improper bullying conduct at this point. If you want to get an official confirmation of the rules from the moderator before continuing, be my guest. Steve, I wanted to sleep on this before I replied. I do agree, there is "unfair play" occurring, unfortunately it is clearly coming from you. The first instance was logfiles 331/340/241 aaand 344. You issued an OOS warning, and I covered myself. You missed the move and immediately tried to end the game. As I noted at the time, it was clear that if the order to cover Miskolcz had not been entered, it had to be a communication error, and I would have checked with you. Now we face a 2nd instance, in this case it had to be again blindingly obvious that your MO warning had been buried in an event play as I played 11th army to get rid of the card. You again, did not check, just proceeded. Let's counter that with how I dealt with your missed IT MO. I sent a clear logfile, after my 4th action in the turn and you acknowledged it. So I reject your offered resolution and ask to replay my CP6. I am happy to refer this matter to the moderator. As a note, I was well aware you could stop the AH RPs, but was happy to trade that for the AP getting none. Let me know how you wish to proceed. |
