Also, the Union force would lose 1 SP in their retreat as Wilderness VA is Confederate contolled. The force remaining there is 2 SPs, and wouth therefore not suffer attrition, so the end result in this case is the same.

I agree the writing of the rule can be confusing, but it is the Overrun Rule. I think the idea is that an overrun of an ungarrisoned fort is what allows you to play EP. Overrun of a costal fort is contemplated because of Fort Monroe, but an Amphibious Assault is not an overrun and is a small battle so it will not permit EP. I think we do need to email Stephane. I am confident he is aware of this ruling. I will copy you.

Hello, and thanks for your note and for referencing the posts on this topic.
Before playing my cards this turn I referred to the rules, which at 5.72 state as follows:
<< […] If a space is occupied solely by an ungarrisoned fort (coastal or counter), then there is no battle, the non-coastal fort counter is removed, and the moving force can continue its movement. An overrun triggers Emancipation including the capture or removal of an ungarrisoned fort, which in all cases regardless of the size of the overrunning force is considered a medium battle for this situation.
DESIGN NOTE: The capture of a fort (whether garrisoned or ungarrisoned) is a Newspaper headline event and is sufficient good news to trigger Emancipation. This also prevents a game trick of evacuating a fort that is about to be overrun to avoid triggering Emancipation.>>
The rule clearly includes to the capture of coastal forts, and the design note clarifies that “the capture of a fort is a newspaper headline event and triggers the Emancipation”.
The Forts St. Philip / Jackson LA is undoubtedly one of the most important forts on the map: in light of the design note I can’t see how the capture of this fort would not be a newspaper headline sufficient to trigger the event.
In my opinion the rules are clear that flagging the forts triggers the Emancipation.
If you still disagree then, of course, let’s contact the referee and request a ruling.

12 1/28/2026 1:09:00 PM Spring 1861 Confederate Message Sorry, but I don't think you can play EP. The condition was not satisfied. An AA against an ungarrisoned coastal fort is not a medium or large battle.

Rules Clarification below because wording in rules is confusing but let me know if you want to ask the referee.

Either player must play this card as an EC on the Strategy Round immediately following a Union large or medium battle victory. Confederate loses 10 SW and 3 SPs (his choice). Union loses 5 SW. Flip GT marker to its Emancipation Proclamation side. Card must be the last one played by a player at which time it can be played as an OC card. If the play of this card as an OC results in a battle victory, there is no Emancipation Proclamation Remove from deck if event is played. If this card is played as an OC or discarded re-shuffle deck at the end of the Strategy Phase.

The GT marker is flipped to its Emancipation Proclamation side.
Union loses 5 SW, plus 3 SW for Changing Fortunes of War, from 103 (+) to 95 (-) SW. Confederates lose 10 SW from 96 (-) SW to 86 (-) SW.
Confederates must eliminate 3 SPs.
